‘Game of Skill Competition’ Terms and Conditions

  1. Information on how to enter and the prize draw form part of these conditions of entry. Entry into the competition is deemed acceptance of these conditions of entry.
  2. The Promoter is Breville Pty Ltd trading as Kambrook (ABN: 98 000 092 928) of Building 2, Port Air Industrial Estate, 1A Hale Street, Botany, NSW 2019.
  3. The competition commences on Monday 2nd June 2014 at 00:01 (AEST) and concludes on Sunday 31st August 2014 at 23:59 (AEDT). Any entry received after the promotional period has closed will be deemed invalid.
  4. Entries close, on the following dates:
    1. Monday 30th June at 23:59 (AEDT) June Entries
    2. Thursday 31st July at 23:59 (AEDT) July Entries
    3. Sunday 31st August at 23:59 (AEDT) August Entries
  5. The winners will be drawn at the offices of Breville Pty Ltd (ABN: 98 000 092 928) of Building 2, Port Air Industrial Estate, 1A Hale Street, Botany, NSW 2019 by a judging panel, on the following dates:
    1. Wednesday 9th July at 11:00am We 2014 (AEDT) x 2 winners drawn - June Entries
    2. Wednesday 13th August at 11:00am We 2014 (AEDT) x 2 winners drawn - July Entries
    3. Wednesday 10th September at 11:00am We 2014 (AEDT) x 2 winners drawn - August Entries
  6. There will be a total of 6 winners (2 x Monthly Winners for June, July & August).
  7. Entry is open to all residents of Australia who are 18 years of age or over with a valid Instagram Account. If the entrant is under 18 years old, you must have your parents’ permission to enter. Employees and their immediate families of the Promoter, participating outlets and their agencies associated with this promotion are ineligible.
  8. The entrant must be following Kambrook on Instagram at the time the prizes are drawn.
  9. Winners will be notified via their Instagram post on their winning entry within 3 days of the draw. Prize-winners will be published on the Kambrook Facebook page https://www.facebook.com/kambrook within three days from being announced
  10. Winners will be required to contact Kambrook to confirm their acceptance of their prize, to ensure they confirm their winning entry. They will need to provide their contact details to Kambrook.
  11. Upon receiving the written notice, the Winners must respond to Kambrook via email to claim the prize within 3 months of the prize draw before a second chance prize draw be conducted.
  12. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. By entering into this promotion, you agree to release Facebook & Instagram from any and all causes of action, losses, liability, damage, expense (including legal expenses) cost or charge suffered, sustained or in any way incurred by Facebook & Instagram in relation to this Promotion.
  13. Any costs associated with accessing Instagram and mobile applications is the Entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid
  14. Personal information will not be supplied to Facebook or Instagram. It is for the use of the Promoter only.
  15. Entry to the competition will be via Instagram https://instagram.com/kambrookau. To enter the competition, entrants will need to do the following:
    1. Visit https://instagram.com/kambrookau
    2. Follow Kambrook Instagram Page
    3. Take a photo of a dish or special ingredient inspired by your favourite cultural cuisine
    4. Include the hashtag listed
    5. And tell us which cultural cuisine will inspire your cooking this winter and why
  16. Submission which must be:
    1. original and creative;
    2. is in English.
  17. Entries must not contain content that is unlawful; fraudulent; breaches intellectual property, privacy, publicity or other rights; or defamatory; obscene; derogatory; pornographic; sexually inappropriate; violent; indecent; profane; abusive; harassing; threatening; or objectionable with respect to race, religion, origin or gender. Any entries breaching this condition will automatically be invalid.
  18. In submitting entries, Eligible Participants must comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
  19. Persons that do not comply with these terms and conditions will be disqualified and will not be considered eligible to take part in the Competition.
  20. Entrants must own all rights in the answer submitted to the competition. The person making the entry warrants that the submission is their own work and not subject to copyright of another party. Entries must be free of claims that they infringe third party rights.
  21. The Competition is a game of skill and chance plays no part in determining the winner.  There will be 6 prize winner/s chosen by a judging panel of the promoter, in its sole discretion, based on the creativity of the questions asked.   
  22. By entering the competition is it understood that entrants have read and understood the terms and conditions, which will be available via the Facebook terms and conditions link on the Facebook Application page
  23. By entering the competition and answering the question, you will go in the draw for a chance to win the following prize:
    1. Kambrook Pressure Express Digital Pressure Cooker (KPR800) valued at $ 119.95
    2. Kambrook 500W Power Drive Food Processor (KFP400) valued at $ 79.95
  24. Total prize pool is $ 1,199.40 in value.
  25. A maximum limit of one prize will be awarded to any entrant whose valid entry is selected.
  26. The Promoter accepts no responsibility for any variation in the value of the prizes. All prize values are in Australian dollars.
  27. The Promoter reserves the right, subject to any applicable gaming authority approval, to substitute the prize with a prize of equal or greater value if the prize is for some reason unavailable.
  28. It is the entrant’s responsibility to advise the Promoter of any change of personal details.
  29. Winners must take the prize as offered. Once the prize has left the Promoter’s premises, the Promoter is no longer responsible for any late or misdirect prizes.
  30. This campaign is a national campaign that includes all states and territories within Australia.
  31. Entry is only open to Australian residents.
  32. Employees, directors, management and any family members of the Promoter are excluded from entry.
  33. Entrants can only register for the competition once.
  34. Prizes are not transferable.
  35. Winners may not exchange their prize for cash or other prizes.
  36. The Promoter shall not be liable for any loss or damage whatsoever suffered during the course of this promotion or associated with delivery of the prize.
  37. To the maximum extent permitted by law, the Promoter makes no representation or warranty as to the quality and/or suitability of the prize.
  38. All personal information collected by the Promoter in relation to this competition will be collected, used and disclosed only for purpose of communicating with the winners of this competition in accordance with the Promoter’s Privacy Policy, available at https://www.aperfectpantry.com.au – All personal information collected from entrants will be destroyed once winners have been contacted and prizes distributed.
  39. The Promoter reserves the right to use winners’ names for promotional purposes only. All entries and information relating to the competition remain the property of the Promoter and can be used to further promote the brand and its associated products.
  40. The Promoter is not responsible for any incorrect or inaccurate information, either caused by you or for any of the equipment or programming associated with or utilised in the competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorized access to or alteration of entries.
  41. The Promoter is not responsible for lost, late, incomprehensible or incorrect entries in the competition. The Promoter also accepts no responsibility for any tax implications that may arise from prize winnings in the competition. You should seek independent financial advice about such matters.
  42. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, the promoter is entitled to cancel, terminate, modify or suspend the competition - subject to any written directions from any applicable regulatory authority.
  43. If for any reason the competition is not capable of running as planned (including but not limited to) technical failures, unauthorized intervention, fraud or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition, the promoter is entitled in our sole discretion to disqualify any individual who tampers with the entry process, and (subject to any written directions given by any applicable regulatory authority), to cancel, terminate, modify or suspend the competition.
  44. The winners release the Promoter,and its related bodies corporate from any and all causes of action, losses, liability, damage, expense (including legal expenses) cost or charge suffered, sustained or in any way incurred by the winner as a result of any loss or damage to any physical property of the winner, or any injury to or death of any person arising out of, or related to, or in any way connected with the Promoter, the promotion or the prize.
  45. The winner agrees to participate in any news media activities surrounding the promotion.
  46. The winners also accept that their entries as provided from Instagram can be used by the promoter Kambrook for the use on the aperfectpantry website or Facebook/Instagram platforms. Winners also agree to allow Kambrook to promote these recipes on all online and offline marketing or advertising resources.
  47. If any winner of a prize has not contacted the Breville office within 3 months of the prize draw to collect their prize, the Promoter will conduct a re-draw/second prize draw for that prize on or after at 11:00am (AEDT) Thursday 11th December 2014 at Breville Pty Ltd (ABN: 98 000 092 928) of Building 2, Port Air Industrial Estate, 1A Hale Street, Botany, NSW 2019, subject to any directions from any applicable regulatory authorities. The winner will be notified via their Instagram account by Kambrook and winners will also be posted on the Kambrook Facebook Page https://www.facebook.com/kambrook
